Terms & Conditions

The conditions that apply when using North Beach Parking Services facilities, parking programs, valet services and website.

These Terms of Service & Parking Conditions (“Terms”) establish the conditions applicable to parking and related services provided, operated, or managed by North Beach Parking Services, Inc. (“North Beach Parking Services,” “NBPS,” “we,” “us,” or “our”).

Please review these Terms before using our services.

Scope of These Terms

These Terms apply, as appropriate, when you:

  • Park at a facility operated or managed by North Beach Parking Services
  • Purchase daily parking
  • Maintain a monthly parking account
  • Use our valet parking services
  • Participate in a corporate parking program
  • Make use of parking obtained through an online reservation platform
  • Visit www.northbeachparking.com; or
  • Otherwise purchase or use parking-related services provided by NBPS

By using the applicable service, you agree to comply with these Terms together with any posted facility rules, parking agreements, reservation conditions, or other applicable notices.

Different locations may have different rates, operating hours, access requirements, vehicle restrictions, and parking conditions.

About Our Parking Services

North Beach Parking Services operates, manages, or provides a variety of parking-related services, which may include:

  • Public and daily parking
  • Monthly parking
  • Hotel valet parking
  • Restaurant valet parking
  • Garage and parking lot management
  • Corporate parking programs
  • Online parking reservations; and
  • Other parking and transportation-related services

The availability and specific conditions of these services vary by location.

Using an NBPS Parking Facility

Customers must observe signs, markings, access requirements, posted restrictions, and reasonable directions provided by authorized parking personnel.

Vehicles must be parked only in authorized areas and in a manner that does not obstruct:

  • Entrances or exits
  • Fire lanes
  • Emergency-access areas
  • Driveways
  • Parking equipment
  • Pedestrian areas; or
  • Other vehicles

Drivers must operate vehicles carefully and comply with posted speed restrictions and applicable laws.

Parking facilities may not be used for unlawful activity, unauthorized vehicle storage, vehicle repair work, or activities that create an unreasonable safety or operational risk.

Daily and Public Parking

Rates and operating conditions for daily parking may differ among facilities.

Customers are responsible for reviewing applicable rates, hours, restrictions, and instructions before parking.

Payment must be made using the method designated for the applicable facility or reservation.

A parking purchase authorizes use of the applicable facility only for the vehicle, date, and parking period associated with the transaction, unless otherwise indicated.

Remaining beyond the purchased parking period may result in additional parking charges or other action permitted by applicable law.

Unless specifically stated otherwise, payment for parking does not reserve a particular individual parking space.

Monthly Parking Memberships

Monthly parking is subject to availability and the rules and restrictions of the applicable facility and parking plan.

Customers are responsible for maintaining accurate:

  • Contact information
  • Vehicle information
  • License plate information; and
  • Payment information

Monthly parking privileges may be restricted to registered vehicles or authorized users.

A monthly parking account does not necessarily guarantee the availability of a particular individual parking space unless that space is expressly assigned under a separate agreement.

Monthly Billing and the 14-Day Cancellation Requirement

Monthly parking fees are billed according to the renewal schedule established for the customer's account.

Where recurring payment is authorized, monthly charges may be automatically processed using the payment method associated with the account.

Customers are responsible for keeping payment information current.

Cancellation Deadline

A monthly customer who wishes to discontinue service must provide cancellation notice at least fourteen (14) days before the next scheduled billing or renewal date.

For example, when the next monthly billing date is September 1, the cancellation request must be received at least 14 days before September 1 to prevent that renewal.

If the cancellation request is received fewer than 14 days before the scheduled renewal date, the upcoming monthly charge may still be processed and cancellation may become effective for the following billing period.

Simply not parking, removing the vehicle, or failing to use the parking account does not constitute cancellation.

Cancellation should be submitted through the applicable monthly parking system or using the cancellation method provided by North Beach Parking Services.

Valet Parking Services

North Beach Parking Services may provide valet parking on behalf of hotels, restaurants, event venues, and other businesses.

Customers using valet service must follow reasonable instructions from authorized valet personnel.

Before turning over a vehicle, customers should remove or appropriately secure valuable or fragile personal property.

When a vehicle is returned, customers should reasonably inspect the vehicle and promptly report any claimed damage, loss, or other incident to the valet or parking personnel.

Claims may be investigated using available information such as valet tickets, photographs, video footage where available, employee records, reservation information, customer statements, and other relevant evidence.

Submitting or receiving a claim does not constitute an admission of responsibility by North Beach Parking Services.

Online Reservations and Parking Platforms

North Beach Parking Services may make certain parking services available through independent online platforms.

SpotHero

Daily online parking reservations may be offered through SpotHero.

A reservation purchased through SpotHero may be subject to SpotHero's own terms concerning the reservation transaction, payment, cancellation, and refund.

Use of the actual parking facility remains subject to applicable NBPS facility rules and parking conditions.

QeasyPark

Online monthly parking enrollment or account services may be available through QeasyPark.

Customers using QeasyPark may also be subject to that platform's terms, payment conditions, and privacy practices.

Third-party platforms operate independently from North Beach Parking Services. NBPS does not control the operation, availability, security, or technology of those independent websites or applications.

Rates, Payments and Billing

Parking rates depend on the facility and service selected.

Payment methods may include:

  • Credit or debit cards
  • Cash at locations where accepted
  • Mobile or electronic payment
  • Online payment; or
  • Other authorized methods

Direct payments to North Beach Parking Services may be processed through Clover or another authorized payment provider.

Transactions completed through third-party platforms may use payment processors selected by those platforms.

Customers are responsible for all properly disclosed parking charges, taxes, and other applicable fees associated with their parking transaction.

A declined or failed recurring payment may result in suspension or termination of monthly parking access.

Refunds and Account Credits

Refund and cancellation eligibility may depend on:

  • The parking service purchased
  • The applicable facility
  • The timing of cancellation
  • The circumstances giving rise to the request; and
  • Any applicable third-party reservation terms

Parking purchased through an independent reservation platform may be subject to that platform's refund and cancellation procedures.

Unless otherwise required by law or expressly approved by North Beach Parking Services, unused parking time, early departure, or a customer's decision not to use available parking does not automatically create a right to a refund or account credit.

Monthly customers remain subject to the 14-day cancellation requirement described above.

Customer and Vehicle Responsibilities

Customers are responsible for operating and maintaining their vehicles in compliance with applicable law.

Customers must:

  • Provide accurate vehicle information where required
  • Maintain required vehicle registration and insurance
  • Follow posted parking instructions
  • Pay applicable charges
  • Secure their vehicles and personal property
  • Protect parking credentials, access cards, or account passwords
  • Avoid causing damage to the facility or other property; and
  • Promptly report significant parking-related incidents

Customers may be responsible, to the extent permitted by law, for damage caused by themselves, their passengers, or their vehicles.

Vehicle Size and Facility Restrictions

Parking facilities may impose restrictions concerning vehicle:

  • Height
  • Width
  • Length
  • Weight
  • Type; or
  • Commercial use

Oversized vehicles may be prohibited at certain locations or may be subject to additional charges where disclosed.

Customers are responsible for determining whether their vehicle complies with clearly posted facility restrictions before entering.

Restricted Conduct and Items

Customers may not use parking facilities in a manner that endangers people or property or materially interferes with parking operations.

Hazardous, explosive, or unlawful materials may not be stored at an NBPS parking facility except where possession is lawful and specifically authorized as necessary for ordinary vehicle operation or other permitted purposes.

Illegal activity is prohibited at all facilities.

Access, Availability and Temporary Closures

Parking availability may be affected by:

  • Maintenance
  • Construction
  • Special events
  • Emergencies
  • Property-owner requirements
  • Government action
  • Safety conditions; or
  • Other operational circumstances

North Beach Parking Services will make reasonable efforts to communicate significant planned interruptions when practicable.

Alternative parking, refunds, or credits are not automatically guaranteed and will depend on the circumstances, applicable agreement, reservation terms, and legal requirements.

Unauthorized Vehicles and Towing

Subject to applicable California and local law, vehicles may be subject to towing, removal, citation, or other legally permitted action when they:

  • Are parked without authorization
  • Occupy restricted or reserved areas without permission
  • Block entrances, exits, driveways, fire lanes, or emergency access
  • Create a safety hazard
  • Materially violate posted parking restrictions
  • Qualify as abandoned under applicable law; or
  • Have unpaid parking charges where removal is legally authorized

Towing and vehicle removal will be performed subject to applicable legal requirements.

Vehicle owners may be responsible for legally authorized towing and storage charges.

Vehicle Damage, Loss and Incident Reporting

Customers should report accidents, suspected theft, vehicle damage, property damage, or other parking-related incidents as soon as reasonably possible.

NBPS may request information necessary to investigate the matter, including:

  • Customer contact information
  • Vehicle information
  • Parking or valet ticket
  • Reservation information
  • Date and approximate time
  • Parking location
  • Photographs or other documentation; and
  • A description of what occurred

The existence of damage or loss while a vehicle is located at a parking facility does not by itself establish responsibility on the part of North Beach Parking Services.

Responsibility will be evaluated based on the circumstances, available evidence, applicable parking or valet agreements, insurance requirements, and applicable law.

Personal Property Inside Vehicles

Customers are encouraged not to leave cash, electronics, jewelry, important documents, or other valuable personal property unsecured inside vehicles.

Except where responsibility is imposed by applicable law or expressly accepted by NBPS, North Beach Parking Services does not assume custody of personal property merely because that property remains inside a parked vehicle.

Lost or missing property should be reported promptly.

Suspension or Termination of Parking Privileges

To the extent permitted by law, NBPS may suspend, refuse, or terminate parking privileges when reasonably necessary because of:

  • Failure to pay
  • Fraud
  • Unauthorized use of parking credentials
  • Material or repeated violations of facility rules
  • Unsafe conduct
  • Threatening or materially disruptive behavior
  • Damage to parking property or equipment; or
  • Other conduct that materially interferes with safe parking operations

North Beach Parking Services does not refuse service for unlawfully discriminatory reasons.

Responsibility for Parking Risks

Parking facilities are environments in which events may occur that are outside the reasonable control of the parking operator, including theft, vandalism, actions of third parties, weather events, accidents, utility failures, and emergencies.

Customers are responsible for maintaining appropriate vehicle and personal-property insurance.

To the fullest extent permitted by applicable law, NBPS is not responsible for losses resulting solely from circumstances outside its reasonable control or from third parties for whose conduct NBPS is not legally responsible.

Nothing in these Terms is intended to eliminate or restrict a responsibility that cannot lawfully be excluded or limited.

Use of Our Website

The North Beach Parking Services website is provided to give customers information concerning our company and services.

Users may not:

  • Attempt to gain unauthorized access to the website or related systems
  • Interfere with website operation or security
  • Introduce malicious software
  • Use automated methods in a manner that materially disrupts the website
  • Misrepresent their identity for fraudulent purposes; or
  • Use the website for unlawful activity

We may restrict website access when reasonably necessary to protect our systems, users, or business operations.

Website Content and Intellectual Property

Unless otherwise indicated, content created for the North Beach Parking Services website—including our name, logos, graphics, photographs, text, and other proprietary material—is owned by or licensed to North Beach Parking Services.

Website access does not transfer ownership or intellectual-property rights to users.

Our proprietary materials may not be reproduced, distributed, modified, or commercially exploited without authorization except where permitted by law.

Privacy and Personal Information

Personal information collected in connection with our website and services is handled as described in the North Beach Parking Services Privacy Notice.

Customers using independent reservation, payment, or parking technology platforms should also review those providers' privacy policies.

Third-Party Websites and Technology

Our website or services may contain links to or interact with independent third-party services.

North Beach Parking Services does not control the content, technology, security, availability, or privacy practices of independent third parties.

Providing a link or making a third-party parking platform available does not mean that NBPS assumes responsibility for the independent operation of that service.

Events Outside Our Reasonable Control

NBPS will not be responsible for delays, interruptions, or inability to provide services resulting from circumstances reasonably beyond our control, such as:

  • Natural disasters
  • Fires or floods
  • Severe weather
  • Utility or communications failures
  • Government actions
  • Civil emergencies
  • Labor disruptions; or
  • Similar extraordinary circumstances

This provision applies only to the extent permitted by applicable law.

California Law

These Terms are governed by the laws of the State of California, except where another law must apply.

Any legal rights or remedies that cannot lawfully be waived by these Terms remain available.

General Legal Provisions

If a particular provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

Failure by North Beach Parking Services to enforce a provision on one occasion does not necessarily waive the right to enforce that provision later.

Additional written agreements may apply to particular parking locations, corporate accounts, valet operations, or property-management relationships. Where applicable, those agreements should be read together with these Terms.

Changes to These Terms

We may revise these Terms as our services, business practices, technology, or legal requirements change.

The current version will be posted on our website with an updated effective or revision date.

Where applicable law requires additional notice of a material change, we will provide such notice.
